List of prohibited and risky areas

The payment services sector is strictly regulated by both the supervision of the Czech National Bank and the Ministry of Finance, as well as by the rules of the VISA and MasterCard payment associations. Below are lists of risk areas that require special access and are subject to non-standard business terms. Here is a list of completely forbidden areas.

Risky sectors:

  • Telecommunication services
  • Providers of computer networks, Internet access, hosting and other online services such as e.g. online storage
  • Pharmacies and dietary supplements retailers
  • Dating and escort services
  • Vendors offering entertainment machines such as jukebox, video game machines, pinball, paintball, laser tag, etc.
  • Government institution

Activation fee for risk sectors 420 EUR
Annual fee for risk sectors 440 EUR

The incumbency to demonstrate a specific authorization to operate applies to:

  • Travel Agents (including a proof of bankruptcy insurance)
  • Pharmacies

Forbidden areas for providing a payment gateway:

  • children adoption
  • pornographic products, services of erotic character
  • products or services displaying or promoting child pornography or other sexual practices with the elements of crime of spreading pornography
  • direct marketing especially for insurance, travel services, other telemarketing without customer prior consent
  • running the betting games, lotteries and casinos, etc. and their internet providers (for card payments)
  • real estate trade
  • The currency exchange office , money transfer companies (non-bank entities) and pay checks,
  • electronic wallets
  • online auctions
  • file sharing
  • the spread of narcotics, psychotropic substances and poisons
  • sale of prescription medicinal products
  • sale of tobacco products incl. e-cigarettes, cigars, pipes and smoking accessories
  • selling counterfeit goods
  • funding of political parties including the extreme left and the extreme right
  • the sale of goods or the provision of services through which it can lead to the promotion or propagation of criminal activities or the circumvention of effective technical means of copyright protection
  • goods or services that promote the extreme left or right and religious sects
  • pyramid and chain business models
  • high-risk commodities (petroleum and natural gas, gold and gold dust, urea, diamonds and other raw materials)
  • trade in toxic substances with an impact on the environment and their storage
  • production and processing of toxic waste and landfills
  • manufacture, purchase and sale of weapons, ammunition and explosives, unless a person has been granted a license from the Czech state authorities
  • sale of non-washed and used clothing and underwear
  • sales of used hygienic and sanitary appliances
  • sales of human and animal body fluids
  • lectures, teaching and training courses falling into the gray zone

Countries not listed in either of the above mentioned groups are rated as low risk countries, European Union countries are considered to be with almost no risk.
