High risk and prohibited areas

The payment services industry is tightly regulated not only by supervision of the Czech National Bank and the Ministry of Finance but also by the regulations of VISA and MasterCard payment associations. Please find below a list of risky areas, which require special approach and are governed by business terms other than standard ones. We also include a list of completely prohibited areas.

Risky areas:

  • Telecommunication services
  • Computer network providers, Internet access, hosting and other online services, such as online storage
  • Pharmacies and food supplement dealers
  • Dating and escort services
  • Businesses offering entertainment machines, such as jukeboxes, videogames, pinballs, paintball, laser tag etc.
  • State agencies

Special business authorization must be demonstrated for:

  • Travel Agents (including a proof of bankruptcy insurance)
  • Pharmacies

Payment gateway cannot be used for following purposes:

  • child adoption
  • pornography, erotic services
  • products or services displaying or promoting child pornography or other sexual practices classified as the crime of dissemination of pornography
  • direct marketing, especially in the field of insurance, travel services, other telemarketing without the previous consent of the customer
  • bets, lotteries, casinos etc., as well as their Internet providers (for card payments)
  • real estate trade (real estate agencies)
  • exchanges, money transfer companies (other than banks) and check companies,
  • electronic wallets
  • online auctions
  • file sharing
  • distribution of narcotics and poisons
  • sale of prescription drugs
  • sale of tobacco products including e-cigarettes, cigars, pipes and smoking accessories
  • sale of counterfeit goods
  • financing political parties including extreme left and extreme right
  • sale of goods or offer of services, which may result in aiding or promoting criminal activity or circumventing effective copyright protection technical measures
  • goods or services promoting extreme left or right and religious sects
  • pyramid and chain schemes
  • high-risk commodities (oil and natural gas, gold and gold dust, urea, diamonds and other raw materials)
  • trading in toxic substances affecting the environment and their storage
  • production and processing of toxic waste and landfills
  • production, purchase and sale of arms, ammunition and explosives, unless the entity holds a license from Czech state agencies
  • sale of unwashed and used clothes and underwear
  • sale of used hygienic and sanitary products
  • sale of human and animal bodily fluids
  • lectures, educational and training courses on topics within the grey zone

Countries not included in any of the above-specified groups are considered low-risk countries. Member States of the European Union are considered countries with almost no risk.
